Song of the Month (Discontinued) User Agreement

Pet Acoustics Song of the Month subscription Services, including but not limited to audio, graphic and editorial content used to implement the Services contain proprietary information and material that is owned by Pet Acoustics Inc. and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or audio materials in any way whatsoever except for the use of the Services for personal use in compliance with this Agreement. No portion of the Services may be distributed, shared or reproduced in any form or by any means, except as expressly permitted by Pet Acoustics, Inc. You agree not to modify, rent, loan, sell, or distribute the Audio Content in any manner, and you shall not exploit the Services in any manner not expressly authorized.

3-Month Limited Warranty Disclaimer

Length of coverage is three (3) months from the date of purchase by the first consumer purchaser of the product. Warranty does not apply to abuse or misuse, including defects or damage that result from improper operation, storage, misuse or abuse, accident or neglect, including but not limited to physical damage (cracks, scratches, etc) to the surface of the product; contact with liquid, water, rain, extreme humidity or heavy perspiration, sand, dirt or the like, extreme heat, or food; use of the Products for commercial purposes or subjecting the Products to abnormal usage or conditions; or other acts which are not the fault or negligence of Pet Acoustics, Inc. Contact the place of purchase for issues and returns.

Waiver of Liability Disclaimer

In no event shall Pet Acoustics Inc. be liable for any direct, indirect, punitive, incidental, special, or consequential damages whatsoever arising out of or connected with the use or misuse of any Pet Acoustics products purchased herein. You agree and acknowledge that any product purchased should be used at your own risk and you should assess the risks individual to your pet before purchasing any product or using any product with or on your pet. You agree that in the event that Pet Acoustics Inc. is deemed liable for any harm caused, the amount which it shall be liable to you shall be limited to the cost of the product. In no event should you allow your pet to use this product unattended, nor should you leave any children unattended in the presence of this product as it may present a choking hazard.

Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrators award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Employer agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
